These Terms of Service set out the standing orders of THEATRE EDUCATORS OF NORTH TEXAS for this website and for the planning work of the wing office. By reading the site, sending a message or requesting a round, you agree to the terms below. Please read them before you send a booking note, and keep a copy for the records of your school or organisation.
1. Agreement to These Terms
These terms form an agreement between you and THEATRE EDUCATORS OF NORTH TEXAS. You accept them when you use this website, when you send a message through the contact desk or when you request, approve or take part in a planned round.
If you act for a school, a district, a festival or another organisation, you confirm that you have the authority to accept these terms on behalf of that organisation. If you do not have that authority, please do not request a round; ask the person who does to review these terms and to write to the office.
If you do not accept these terms, please do not use this website and do not request a round. You may still telephone the office to ask a general question, but a planning round will not begin until the terms are accepted by an authorised person.
2. Who We Are
THEATRE EDUCATORS OF NORTH TEXAS is a theatre education and systems planning office based in Dallas, Texas. The office plans and coordinates workshop rounds, festival staging rounds, student matinee weeks, costume rack days, audition clinics and call board evenings.
The postal address of the office is 11611 Inwood Rd, Dallas - 75229-3022, United States (US). The contact email address is tickets@tenttheatre.org and the telephone number is +13292082342.
This website is published under the developer name Theatre Educators NTX, which refers to the same office. In these terms, the words we, us and our mean THEATRE EDUCATORS OF NORTH TEXAS, and the word you means the visitor, teacher, administrator or partner who uses this site or requests a round.
3. Use of the Website
This website is provided so that teachers, school staff and festival partners can learn about the rounds we offer, read our legal notices and reach the wing office. You may read the pages, print a page for your own planning and send a message through the contact desk.
You may not copy the site in bulk, republish its text as your own, mirror it on another domain or use automated tools to scrape its content without a written agreement. You may not attempt to gain access to a system behind the site, probe it for weaknesses without permission or interfere with its normal operation.
We work to keep the site available and accurate, but we do not promise that it will always be online or that every detail will always be current. If a page is wrong, tell the office and we will correct it as soon as we can.
4. Booking Requests
A booking request is an invitation to plan a round; it is not a confirmed engagement. The office reviews each request against the calendar, the bench of teaching artists and the needs of the room before it offers a plan.
A request should name the school or organisation, the room, the grade band, the preferred date or window, the length of the round and any material constraint that the host already knows about. The more accurate the note, the faster a plan can be drawn and the fewer details must be corrected later.
The office may decline a request for any lawful reason, including a date clash, a staffing gap, a room that cannot safely hold the planned work or a request that falls outside the services described on the site.
5. Confirmation and Scheduling
A round becomes confirmed when the office sends a written confirmation that names the teaching artist, the date, the arrival hour and the host contact. Until that confirmation is sent, no round is binding on either side.
The confirmation includes a calendar page, a floor sketch and a materials note. The host should review all three within the period stated in the confirmation and should reply with any correction as soon as possible. A round may need to be redrawn if the room or the date changes after confirmation.
Times in a confirmation are working times, not public show times. The office will state the load-in hour, the run hour and the strike hour for each round, and the host is expected to have the room ready and open at the load-in hour.
6. Host School Duties
The host school agrees to provide a safe, cleared room for the round, a named contact who will meet the teaching artist at the entrance and the materials listed in the confirmation. The host also agrees to keep the floor free of hazards, to secure a power supply where one is required and to tell the office in advance of any access restriction such as a locked gate or a lift that is out of service.
The host agrees to ensure that a member of its own staff remains present for the whole round and that students are supervised in line with the policies of the school. The teaching artist leads the work, but the school remains responsible for the supervision and conduct of its students.
The host agrees to provide accurate information about the room, the class and the date. Where a room cannot hold the planned work safely, the host should tell the office before the round so that the plan or the room can be adjusted.
7. Student Safety and Supervision
The safety of students is the first concern of every round. The office briefs its teaching artists on working with young people and on the rules of the host school before a visit. The host school briefs its own staff on the same rules and remains responsible for its students throughout the round.
A teaching artist will stop an activity if a room is unsafe or if a student is at risk. In that case the artist will ask the host contact to pause the round while the problem is resolved. The office will not expect an artist to continue a round in a room that cannot be made safe.
Where a round involves physical work, the artist explains the warm-up, the ground rules and the stop signal before the work begins. A student who needs to stop at any point is expected to be able to do so without penalty, and the host school is asked to support that expectation.
8. Materials and Equipment
The materials note in a confirmation lists the items that the host school supplies. These items are usually simple, such as chairs that can be moved, a clear floor, a table for scripts and a set of scripts printed by the teacher. Where a costume rack day is planned, the note lists the rail space and the mirror that the host should provide.
Items that the office brings, such as props, small wardrobe pieces, scripts owned by the office or a set of teaching cards, remain the property of the office unless the confirmation states otherwise. The host agrees to return these items in the condition in which they arrived, allowing for ordinary wear.
If an item is damaged during a round, the host should tell the office within two working days. The office will assess the damage and agree a reasonable remedy. Ordinary wear from a normal classroom round is not treated as damage.
9. Fees and Payment
A confirmed plan states the fee for the round and the payment terms that apply. A school or a district may also receive a written purchase order instruction if that is the route its finance office requires.
The office may ask for a deposit to hold a date, particularly for a festival staging round or a student matinee week that reserves a venue and a team for several days. The deposit amount and the terms are stated in the confirmation before the round is confirmed.
Invoices are payable within the period stated on the invoice. Late payment may affect the priority given to a future booking. If a payment is disputed, the host should write to the office within ten working days so that the matter can be reviewed and resolved.
10. Changes and Cancellations
A host who needs to move a date should tell the office as soon as the need becomes known. The office will look for another date and will carry the plan forward wherever possible. A change made more than seven days before a single visit usually carries no charge; a change made closer to the date may carry a fee if a teaching artist has already blocked the time.
A festival round or a matinee week involves a larger commitment of staff, a venue and a team. The confirmation for those rounds states the change windows and the cancellation terms that apply. A cancellation inside a stated window may be charged in part, to cover the cost that the office has already incurred.
The office may change or cancel a round if a teaching artist becomes unavailable, if a room is unsafe, if severe weather makes travel impossible or if a government order requires it. In that case the office will offer a substitute artist, a new date or a refund of any amount paid for the affected work, at the choice of the host.
11. Intellectual Property
The text, layout, code and design of this website belong to the office. The office also owns the plan templates, the round drawings and the written guidance that it prepares for a host, unless a written agreement says otherwise.
A host school may use a plan for the round that it covers, may share it with the staff who run that round and may keep a copy in its own planning records. A host may not resell a plan, publish it as a training resource for another organisation or use it to run a competing service without written permission.
Scripts, music, images and other works used in a round remain the property of their own owners. A host school is responsible for holding any licence that a performance or a reading requires. The office can advise on a licence but does not grant one on behalf of a rights holder.
12. Acceptable Conduct
You agree to use this website and the services of the office in good faith. You agree not to send a message that is unlawful, abusive, threatening or deliberately misleading, and not to use the contact desk to send unsolicited advertising.
You agree not to present false information about a school, a class, a room or a date in order to secure a booking. If a detail turns out to be wrong, tell the office, and the plan can usually be adjusted without harm.
The office may pause or end a working relationship if conduct makes a round unsafe or unworkable. Where a round is ended for that reason, the office will explain the decision in writing and will settle any amount that is fairly due for work already done.
13. Third Party Links and Venues
This website may link to a venue, a school district, a rights holder or a partner. Those links are provided for convenience, and the office does not control the content or the practices of a linked site.
When a round takes place in a venue owned by another organisation, the rules of that venue apply alongside these terms. A venue may set its own access hours, fire rules, loading restrictions and insurance requirements, and the host school is responsible for meeting them.
The office is not a party to an agreement between a school and a venue, a bus company or a rights holder. Those arrangements belong to the organisations that make them.
14. Disclaimer of Warranties
This website and the information on it are provided as they stand. The office works to keep the information accurate and useful, but it does not promise that the site will be free of error or interruption, or that a page will always reflect the latest schedule or the latest plan.
The office does not promise a particular outcome from a round. A workshop, a clinic or a festival can support a class and give a teacher useful material, but the progress of a student depends on many things that lie outside the control of any teaching artist.
Nothing in this section removes a right that a law gives you and that cannot be excluded by agreement.
15. Limitation of Liability
To the extent that a law permits, the office is not liable for an indirect, incidental or consequential loss that arises from the use of this website or from a round. This includes a loss of profit, a loss of a grant, a loss of a booking with another party and a loss of reputation.
Where the office is found liable for a direct loss, the total liability for a single round is limited to the fee paid or payable for that round. Where a claim does not arise from a round, the total liability is limited to a reasonable amount that reflects the scale of the office and the nature of the claim.
Nothing in this section limits liability for fraud, for wilful misconduct or for a matter that a law does not allow to be limited. The office does not seek to avoid responsibility for a safe and careful plan.
16. Indemnity
If a claim is brought against the office because of a breach of these terms by a host school, the host agrees to meet the reasonable cost of defending the claim and any amount that is finally awarded, provided that the office tells the host promptly and gives the host a fair chance to take part in the defence.
This duty does not apply where the claim arises from the negligence or the misconduct of the office or of a teaching artist engaged by the office.
Each side agrees to cooperate in good faith with an insurance provider or a legal adviser that is dealing with a claim connected to a round.
17. Privacy and Records
Our handling of personal information is described in the Privacy Policy published on this website. The Privacy Policy forms part of the background to these terms and explains how a message, a booking note and a school record are treated.
A host school agrees to share only the information that a round needs and to have the authority to share it. Where a district requires a written data agreement, the office will sign that agreement before a round begins.
The office keeps a plan and a short debrief note after a round so that a return visit can start from a known place. A host may ask for that record to be corrected or deleted, as described in the Privacy Policy.
18. Governing Law and Disputes
These terms are governed by the laws of the State of Texas and the applicable laws of the United States. A dispute that cannot be resolved by a conversation will be handled in a court of competent jurisdiction in Dallas County, Texas, unless a mandatory law requires another forum.
Before a formal step is taken, both sides agree to try to resolve the matter in good faith. A host should write to tickets@tenttheatre.org with the details of the concern, and the office will reply with a named contact who can discuss the matter.
If a part of these terms is found to be unenforceable, the rest of the terms continue in force. A failure to enforce a term on one occasion does not mean that the term has been waived for the future.
19. Changes to These Terms
The office may update these terms from time to time. When an update is important, the effective date at the top of this page will change and a notice will appear on the site before the update takes effect.
A confirmed round is governed by the terms that were in force when the confirmation was sent, unless the host agrees to a later version in writing. A new round is governed by the terms in force when its confirmation is sent.
If you do not accept an updated version, you may stop using the site and ask the office to close your planning records, subject to any record that the office must keep by law.
20. Contact Information
Questions about these terms, a booking matter or a concern about a round can be sent to the wing office using any of the routes below. The office answers five days a week and a person reviews every message.
